UAE visa overstay fines: what an employer needs to know

An employee's residence visa lapsing is one of the most common — and most avoidable — compliance costs for a UAE company. This guide explains what the fine actually is, when it starts running, and what the published sources agree and disagree about.

The daily rate is AED 50

The ICP fine-payment service card lists a single rate for expiry of the permitted stay, or cancellation or expiration of an entry visa, residence permit, exit permit or newborn registration: AED 50 for each day.

The same flat rate covers visit, tourist and residence visas. It replaced the older AED 25 a day for residence permits, and it has been the standard since 2023 — not, as is widely repeated online, since February 2026. No announcement of a February 2026 change exists. The date appears to have been copied from a "last updated" stamp on a government FAQ page and passed from site to site since.

A month past the point where fines start is therefore about AED 1,500 for one person, before the cost of arranging an urgent renewal or a departure.

When the clock starts — and why four official answers exist

Fines do not run from the expiry date. They run from the day after the applicable grace period ends. Which grace period applies is the part nobody agrees on, and all of the following are published by UAE authorities.

ICP sets four tiers after a residence permit expires or is cancelled: 180 days for Golden, Green and Blue residence holders and their families, widows and divorcees, students, and foreign-passport relatives of UAE citizens; 90 days for skilled workers in levels one to three and property owners; 60 days for permits held through a guarantor or host; and 30 days for everybody else.

GDRFA Dubai states a flat 60 days on its private-sector and family renewal service cards. The UAE Government portal describes "up to six months, according to resident category", and gives dependants a six-month window from expiry or cancellation.

For an ordinary employment visa the shortest published tier is 30 days, and that is the one to plan against. Treat the expiry date itself as the deadline and the grace period as what saves you when something goes wrong — not as time you intended to use.

Who pays

For dependants the position is stated plainly: if the sponsor fails to renew or cancel a dependant's visa, the sponsor may be liable for the fine.

For an employee on a company visa, no official source divides overstay fines between employer and employee. What is official is that the employer carries the recruitment costs under the Labour Law, and that the sponsor is the party the file sits with. In practice the company is the one the authorities deal with, and the company is the one that cannot file anything else until it is settled.

Checking and paying

GDRFA Dubai runs a Fines Inquiry Service searchable by file number, UDB number, Emirates ID or passport number. It shows fines on your own file and on those under your sponsorship — which is how an employer checks a whole team rather than one person at a time.

Fines are paid through ICP Smart Services, signed in with UAE Pass, available 24 hours a day, with a stated completion of two days. The ICP call centre is 600522222.

Paying is not the end of it. The person's status still has to be corrected, or they have to leave.

Leaving the country after an overstay

Departure needs a departure permit from ICP. It costs AED 200 plus an AED 100 smart services fee, and it cannot be issued until all outstanding fines are paid.

The permit is valid for seven days from issue. After that the AED 50 a day resumes. Processing is stated at two days, so a permit applied for on the day somebody hoped to fly is already late.

Fines can sometimes be reduced

GDRFA Dubai operates an exemption service for violators of the Residence Law: a request to a fines committee to waive or reduce the penalty, supported by a passport copy and a letter explaining the violation and the inability to pay. Where the sponsor is an individual the fee is AED 15.75. ICP runs an equivalent process for administrative delay fees.

Waivers are also granted for events outside anybody's control. On 4 March 2026 ICP waived overstay fines incurred on or after 28 February 2026 for people who could not leave because of regional airspace closures and suspended flights.

Neither is something to plan around. Both are worth knowing about when a genuine problem has already happened.

Two further traps worth knowing

A resident who stays outside the UAE for more than 180 consecutive days has their residence visa nullified automatically. Re-entry permit applications attract AED 100 for every 30 days or part of 30 days spent outside.

At the far end, illegal residence is dealt with under Federal Decree-Law No. 29 of 2021. Administrative deportation is issued by ICP, a person under a deportation order may be detained for up to 30 days extendable by a similar period with the Federal Public Prosecutor's approval, and a deported person cannot return without special permission from the ICP Director General.

The tidy tables of "90 days overstay equals a one-year ban, 180 days equals five years" that circulate online are not published by any authority. There is no official day-count-to-ban schedule.

Why visas lapse inside companies

The renewal depends on other documents being in order first: a passport with at least six months left, a medical fitness test, valid health insurance, and an Emirates ID application.
Dates are kept in a spreadsheet nobody opens during leave, handovers or a busy month.
The person who tracked it has left, and nobody else knew the list existed.
The employee assumes the company is handling it; the company assumes the employee will say something.
